New Zealand Divine Society Wins legal Battle

Yogi Divine Society New Zealand(YDSNZ) a duly registered charitable trust under the charitable trust’s act 1957 in New Zealand and also registered under the NZ charities act 2005 has since its inception in 2001 has under the leadership and guidance of its president Shri Mohan Daya been serving and contributing to the greater New Zealand society in many ways including but not limited to the upliftmen of spiritual, social, psychological and many other philanthropic needs of the New Zealand society.
As an example,Yogi Divine Society has served the community by holding weekly assemblies for youths, elders, disadvantaged and many families across New Zealand. Furthermore, YDSNZ has regularly carried out relief activities for the betterment of humankind this includes holding blood donation camps, community services and disaster relief activities such as food packaging distribution to name a few.
Shri Mohan Daya the president of YDSNZ is a very prominent figure in New Zealand and a well established businessman , community volunteer and philanthropist. He is a descendant of the pioneering family in the early diaspora settlers from India.
Since his early twenties he has served the greater Indian diaspora in the form of his enormous support with the Auckland and NZ Indian association, with the establishment of Bhartiya Mandir, Radha Krishna temple,Mahatma Gandhi centre and many other temples, charitable organisations and community groups.divine satsang 01
His leadership of the YDSNZ has been a major factor in facilitating and achieving a substantial growth in membership, its
support, success, achievement’s and prosperity. Shri Mohan bhai Daya has worked tirelessly towards upholding H.D.H Hariprasad Swamiji’s dream of building a youth cultural centre in Henderson.
Quite often such noble dreams are presented with obstacles and challenges which test the faith in one’s beliefs and principles.
H.D.H Hariprasad Swamiji’s demise left his followers heartbroken and shattered with the mischief caused by Premswaroop das of Sokhda and his associates. Times were dark and gloomy, malafide intentions emerged and conspiring along with skullduggeries began.
Luckily with the Spiritual guidance of H.D.H Guruhari Prabodhjivan Swami Maharaj, Yogi Divine Society NZ members were able to pursue and uphold the truth. Overwhelmingly majority members in NZ and most of the members of societies worldwide were able to avoid falling prey to malafide intentions.
Premswaroop Das of Sokhda a self proclaimed spiritual head of YDS India and his followers Ashok Rohit, Hemant Rama, Rakesh Patel and Chirayu Bhatt commenced to disparage H.D.H Hariprasad Swamiji’s most beloved and trusted saints (who he had vested his powers for YDSNZ administration) Ashokbhai Patel and Sadhu Shashvatswaroop swami.
Premswaroop das and Ashok Rohit sought to usurp power and acquire the YDSNZ Society and its assets through sending Shri Mohan Daya a legal notice. Upon discovering the malafide intentions and potential detriment to the society, Shri Mohan Daya through his lawyer Radhe Nand refused to be scummed to their wrongful demand and put them on NOTICE that it will not happen and any such action will be vigorously defended.
Ultimately Ashok Rohit took this matter to the high court as plaintiff against Shri Mohan Daya. The high court ruled in Mr Daya’s favour declaring that there is no evidence to suggest that Premswaroop Das of Sokhda is the successor of H.D.H Hariprasad Swamiji and all the powers are legally vested in Mr Mohan Daya, his executive committee and the democratic will of the members of Yogi Divine Society NZ- an overwhelming 364 out of 390 members attended the SGM who voted in 100% in favour of Shri Mohan Daya. Courts at all level in Nz have consistently held Shri Mohan Daya and the executive members of YDS NZ to be the lawful body.
Similar attempts have been made to acquire properties worldwide by Premswaroop das and his associates with similar powers given to democratic practices. The actions of Premswaroop Das of Sokhda has resulted in millions of dollars of financial loss and millions of dollars wasted due to delays in construction of the Atmiya Youth Cultural Centre due to judicial proceedings, along with broken sentiments of hundreds of members of the society who were elated to serve the local community through the proposed cultural centre. Premswaroop Das malafide intentions extend far beyond the shores of New Zealand; over 200 saints were mistreated, tortured and illegally confined in a place which they thought was home. This led to the intervention of the High Court of Gujarat, who then ordered an immediate release of all 200 and more saints through a habeas corpus petition, filed by well-wisher devotees of H.D.H Hariprasad Swamiji. This puts a serious question mark on the character of Premswaroop Das of Sokhada.
Mr Daya and the society are thankful to the courts of New Zealand who have recognised the truth and restored our faith in democratic practices.
